A Waco criminal accused of sexual assault pleads guilty to lesser charges and is released from prison

WACO, Texas (KWTX) – A three-time convicted felon accused of sexually assaulting the mother of his children in 2022 pleaded guilty to a lesser charge Thursday and was expected to be released from prison.

Richard Dwayne Bogans, 56, of Waco, pleaded guilty to a Class A misdemeanor count of domestic assault as part of a plea deal in 54th State District Court in Waco in which prosecutors reduced the charge to second-degree sexual assault and recommended a sentence of 200 days in prison district.

Judge Susan Kelly accepted the plea deal and gave Bogans, who faced up to 20 years in prison for sexual assault, credit for 112 days spent in county jail. His attorney, Darren Obenoskey, said county jail inmates receive two days of credit for each day they spend in jail, adding that Bogans will likely be released Thursday evening.

The guard confirmed that officials were reviewing Bogans’ release papers late Thursday afternoon.

In June 2023, Bogans was charged in a sealed indictment with sexually assaulting a woman at her Proctor Avenue home in February 2022.

He was indicted under seal because Waco police did not arrest Bogans during the incident and sent the case to the McLennan County District Attorney’s office as a grand jury referral.

According to police records, Bogans and the woman were arguing. Waco police said Bogans left the residence but returned and sexually assaulted her.

Arrest records show the woman told police she resisted the assault and told Bogans she didn’t.

Court records show DNA evidence linking Bogans to the crime was confirmed in the Combined DNA Index System, a national DNA database.

Obenoskey said prosecutors agreed to reduce the charges and recommend time served because the woman changed her mind about reporting the assault and was not willing to cooperate with the district attorney’s office.

Bogans was convicted of sexual assault and forgery in Denton County and sentenced to six years in prison in 1991. He was paroled in 1995.

Court records show that in November 2004, he was also sentenced to three years in the Leon County Jail for marijuana possession and was released on parole in December 2005.
