The Supreme Court has refused to entertain PIL seeking investigation into the death of Subhas Chandra Bose

The petitioner submitted that there is no final certainty on the aspect of Bose’s death as no final conclusion had been reached by the Khosla Commission of 1970 and the Shah Nawaz Commission of 1956 on the disappearance of Bose.

It was alleged that Bose did not die in the 1945 air crash and therefore the Court can order an inquiry.

The petitioner further sought a declaration from the Court that it was the Azad Hind Fauj led by Bose who helped India achieve independence from Britain in 1947.

“We are not experts. You are a political worker, go and take the case in your party. We are not the solution for everything. Sarkar ko chalana court ka kaam nahi hai (It is not the job of the court to rule the government to lead)” Justice Kant observed while dismissing the PIL.
